Who is eligible for IEEPA tariff refunds? +
Any Importer of Record (IOR) who paid IEEPA tariffs between February 4, 2025 and February 24, 2026 is eligible. This includes IEEPA tariffs on China, Canada, and Mexico, and reciprocal tariffs on all other trading partners. Only the IOR listed on CBP Form 7501 can file for refunds. Section 301, Section 232, and AD/CVD duties are NOT included โ€” only IEEPA duties were struck down.
What is the deadline to file? +
You have 180 days from the date each entry was liquidated to file a CBP protest. The earliest IEEPA entries began liquidating in December 2025, meaning some protest windows start closing in June 2026. Each entry has its own deadline based on its liquidation date. Check your deadlines page and ACE portal to find your specific dates.
What is the CAPE portal? +
CAPE (Consolidated Administration and Processing of Entries) is CBP's new system within ACE for processing IEEPA refund claims. Importers and brokers submit claims via CSV upload containing entry-level data. CBP is targeting a launch of approximately late April 2026. Our CAPE Guide covers the details.
Can I file my claim myself without a broker? +
Yes. CBP's CAPE portal allows importers to submit their own claims via CSV upload. Our free guides walk you through the entire process โ€” from ACE setup and ACH enrollment to preparing your entry data and submitting through CAPE. No broker required, though you can still use one if you prefer.
Are Section 301 or Section 232 tariffs refundable? +
No. Only IEEPA tariffs were struck down by the Supreme Court. Section 301 tariffs (primarily on Chinese goods, 7.5โ€“100%), Section 232 tariffs (steel and aluminum, 10โ€“50%), and antidumping/countervailing duties all remain in effect.
