We may facilitate introductions to third-party legal service providers, customs brokers, or litigation funders. Any engagement with such third parties is governed by your separate agreement with them, and we make no representations about the quality of their services.

ClaimFlow does not guarantee that you will receive a tariff refund or any specific outcome. Eligibility for refunds depends on numerous factors outside our control, including but not limited to: the status of your import entries, applicable government processes, court rulings, administrative decisions by U.S. Customs and Border Protection, and applicable deadlines.

Language on our site such as “you may be entitled” or “you may have a valid claim” indicates potential eligibility and is not a guarantee of recovery.

Registration and initial assessments through the Services are currently provided at no charge. If we introduce paid features or services in the future, we will clearly disclose applicable fees before you incur any charges. You will not be charged without your prior explicit consent.

If we connect you with third-party service providers (such as customs brokers, attorneys, or litigation funders), those parties may charge separate fees governed by their own agreements with you.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12 — Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAIMFLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Claimflow and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14 — Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered under the rules of the Singapore International Arbitration Centre (SIAC). The arbitration shall be conducted in English.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

15 — Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting of the revised Terms with an updated “Last updated” date. Your continued use of the Services after the posting of changes constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

We may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms which by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.
